Terms of Service

1. Scope
These Terms of Service ("Terms") apply to the use of the software and services ("Service", "OneDash") provided by OneDash via the website and application at onedash.live and related domains. The parties are you as user ("Customer", "You") and OneDash ("we", "Provider"). Deviating customer terms are not accepted unless we expressly agree in writing.
2. Contract Formation and Account
The contract is formed when you register and use the service (e.g. after completing the onboarding wizard and, if applicable, a paid subscription). You provide accurate information and keep your account data up to date. You are responsible for keeping your credentials confidential. An account is authorized for use by one organization (agency); sharing with third parties outside your organization is not permitted.
3. Service Description
OneDash provides a platform-based solution that enables agencies to offer their clients (e.g. advertising customers) a personalized dashboard via magic link. The scope includes, among other things:
- Creating and managing clients and magic links
- Connecting Meta (Facebook/Instagram Ads) per client to display metrics
- Display of metrics and funnel in the client dashboard
- Optional: AI-generated insights and next steps ("AI Insights") in the client dashboard
- Sending magic links via email
- Billing via OneDash (number of clients and any add-ons)
The specific scope depends on the chosen subscription and the features displayed in the application. We reserve the right to develop and extend the service within technical and operational limits; we will avoid material deteriorations or announce them appropriately.
4. Payment and Prices
Billing is handled by OneDash. Prices and billing terms (e.g. per client/month, add-ons such as AI Insights, white-label, additional channel) are shown in the application and when subscribing. Payment is due monthly in advance or as indicated. In case of payment default, we may restrict or suspend access after prior notice and expiration of a reasonable period (e.g. "billing_suspended"). Prices are in EUR plus applicable VAT.
5. Usage Obligations and Prohibited Use
You use the service only within the agreed scope and applicable laws. You ensure that you are authorized to use and provide to us or our processors the ad data you connect (e.g. Meta) and the data you enter (e.g. client names, email addresses). Prohibited uses include misuse (e.g. spam, distribution of harmful content), circumventing access restrictions, sharing credentials with unauthorized parties, and using the service for unlawful purposes. We may suspend or terminate the account in case of violations.
6. Availability and Support
We strive for high availability of the service; no specific availability guarantee is given. Maintenance will be announced where possible. Support is offered via the provided channels (e.g. email to hello@onedash.live); no specific response time is guaranteed unless separately agreed.
7. Liability
We are fully liable for intent and gross negligence, for damages from injury to life, body or health, and otherwise under product liability law. For slight negligence we are liable only for breach of essential contractual obligations (cardinal obligations) and only up to the foreseeable, typically occurring damage; in such cases liability is limited to the foreseeable damage at contract formation. The foregoing limitations also apply in favor of our vicarious agents. Additional liability is excluded.
8. Termination and Term
The subscription can be terminated at the end of each billing period (e.g. end of month); termination is via the means provided in the application (subscription management) or by email to hello@onedash.live. We may terminate the account for material breaches of these Terms or payment default after expiration of a notice period. Upon termination of the contract, access to the service ends; we delete or anonymize your data promptly unless legal retention obligations apply.
9. Changes to Terms and Service
We may amend these Terms for good cause (e.g. new features, legal requirements). Material changes will be communicated at least four weeks before taking effect (e.g. by email or in the application). If you do not object before effectiveness, the amended Terms are deemed accepted. We will inform you of your right to object in the notice. In case of objection, the contract may be terminated at the previous term.
10. Final Provisions
The law of the Federal Republic of Germany applies excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction for disputes is, to the extent permitted by law, the provider's seat (KulturShift LLC, 30 N Gould St, STE R, Sheridan, WY 82801, USA). Should individual provisions be invalid, the validity of the remaining provisions is unaffected. You may view and save these Terms in their current version on this page.
